5. Payments and Subscriptions

• Payment Processing: All payments for DuskVPN services are processed securely through Stripe. We do not store or handle your full payment information. By using our services, you agree to Stripe’s payment terms.
• Subscription Plans: We offer subscription plans for our VPN services. By subscribing, you agree to the payment terms, including the price, billing cycle, and automatic renewal unless canceled.
• Refunds: DuskVPN offers refunds in accordance with our Refund Policy. Refunds will be processed through Stripe and are subject to their terms.

6. User Conduct

When using DuskVPN, you agree to the following:

• Lawful Use: You will not use our services for any illegal or unauthorized purpose, including but not limited to:
  • Engaging in illegal activities such as hacking, fraud, or the distribution of malicious software.
  • Violating intellectual property rights.
  • Engaging in activities that violate any applicable laws or regulations.
• No Harmful Activities: You will not attempt to damage or impair DuskVPN’s systems or services, nor will you misuse our services to engage in harmful activities.

7. Prohibited Use

The following activities are strictly prohibited:

• Spam & Fraud: Using DuskVPN to send unsolicited communications (spam) or commit fraudulent activities.
• Illegal Content: Engaging in or promoting activities related to illegal content, including child pornography, trafficking, or harassment.
• Unauthorized Access: Attempting to gain unauthorized access to any systems or networks.

Violation of this section may result in suspension or termination of your account.

8. Termination

We reserve the right to terminate or suspend your account at our discretion, without notice, for violations of these Terms or for any reason we deem necessary to protect DuskVPN or its users. Upon termination, your access to the VPN service will be revoked, and you will not be entitled to a refund unless specified in our Refund Policy.

You may also cancel your account at any time. Cancellation of services does not entitle you to a refund unless specified in the Refund Policy.

9. Disclaimer of Warranties

DuskVPN is provided “as is” and “as available.” We make no warranties, whether express or implied, regarding the service’s performance, reliability, or fitness for any particular purpose. We do not guarantee that our services will be uninterrupted, error-free, or completely secure.

10. Limitation of Liability

To the maximum extent permitted by law, DuskVPN, its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Use or inability to use DuskVPN services.
• Unauthorized access to or alterations of your data.
• Any third-party conduct or content on the service.

In no event shall our total liability to you exceed the amount paid by you for DuskVPN services within the preceding 12 months.

11. Indemnification

You agree to defend, indemnify, and hold harmless DuskVPN, its affiliates, and its employees from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of our services, violation of these Terms, or violation of any third-party rights.

These Terms and your use of DuskVPN shall be governed by and construed in accordance with the laws of the State of Idaho, USA, without regard to its conflict of law principles.

14. Dispute Resolution

Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Boise, Idaho, unless otherwise agreed by both parties.
